Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) form a legally binding agreement between you (“you”, “user”) and PrepPath (“we”, “us”, “our”), the operator of preppath.com.au and the PrepPath application (together, the “Service”).

By accessing or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you are under 18, a parent or guardian must review and agree to these Terms on your behalf before you use the Service.

2. Description of Service

PrepPath provides online practice questions and exam preparation tools designed to help Australian students prepare for NAPLAN, Opportunity Class (OC), and Selective High School examinations.

PrepPath is an independent service. We are not affiliated with, endorsed by, or in any way officially connected to the Australian Curriculum, Assessment and Reporting Authority (ACARA), the New South Wales Department of Education, or any other government body. “NAPLAN” is a registered trademark of ACARA. References to NAPLAN, OC, and Selective exams on this Service are for descriptive purposes only.

We do not guarantee that use of the Service will result in any particular examination outcome or score.

3. Accounts

You may use parts of the Service without an account. To access session history, progress tracking, and personalised question rotation, you must register an account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at preppathwebapp@gmail.com if you become aware of any unauthorised access to your account.

You must provide accurate information when creating your account. You may not create an account on behalf of another person without their authorisation, except that a parent or guardian may create and manage an account on behalf of their minor child.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Reproduce, distribute, or commercially exploit any content from the Service without our written permission
  • Attempt to scrape, crawl, or systematically extract questions or content from the Service by automated means
  • Attempt to reverse-engineer, decompile, or otherwise access the source code or underlying systems of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Share your account credentials with others or allow multiple users to access the Service through a single account (unless expressly permitted under a school or class licence)
  • Misrepresent your identity or affiliation

5. Subscriptions and Payment

Certain features of the Service may be offered on a paid subscription basis. Where this applies:

  • Subscription fees are stated in Australian dollars (AUD) and include GST where applicable
  • Payment is processed by a third-party provider (Stripe). We do not store your payment card details
  • Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings or by contacting us

6. Refund Policy

If you are not satisfied with a paid subscription, you may request a full refund within 7 days of your initial purchase by emailing preppathwebapp@gmail.com. Refund requests made after 7 days will be considered on a case-by-case basis.

This refund policy is in addition to, and does not limit, any rights you have under the Australian Consumer Law.

7. Intellectual Property

All content on the Service — including practice questions, explanations, software, design, and branding — is owned by or licensed to PrepPath and is protected by Australian and international copyright law.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your own personal, non-commercial educational purposes. This licence does not permit you to reproduce, republish, or distribute any content from the Service.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:

  • The Service will be uninterrupted, error-free, or free of viruses or other harmful components
  • Any question, answer, or explanation is free from errors (though we take reasonable care to ensure accuracy)
  • Use of the Service will improve a student's examination performance

Nothing in these Terms excludes any guarantee, warranty, or right that cannot be excluded under the Australian Consumer Law.

9. Limitation of Liability

To the maximum extent permitted by law, PrepPath's total liability to you for any claim arising out of or in connection with these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim (or AUD $50 if you have not made any payment).

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of educational opportunity, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits our liability for fraud, personal injury caused by our negligence, or any liability that cannot be excluded by law.

10. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

We reserve the right to suspend or terminate your account at any time if you breach these Terms or if we reasonably believe your use of the Service is harmful to other users or to us. We will give you reasonable notice where practicable.

You may close your account at any time by contacting us at preppathwebapp@gmail.com. Upon account closure we will delete your personal data in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes we will notify registered users by email at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or in connection with these Terms.
